Family Law: The dissolution of a marriage is a time of stress and confusion. There can be financial concerns, property and business divisions to decide, child custody and support issues to determine. Sometimes, a client contacts the firm and some or all of those decisions have been made among the parties. At other times, negotiation, mediation and sometimes even litigation is necessary to protect.
Contested Divorce/Uncontested Divorce: At the law offices of Gillespie, Shields & Associates, P.A., in Phoenix and Mesa, our lawyers are dedicated to serving our clients involved in divorce proceedings, whether contested or uncontested. In an uncontested divorce, a married couple has decided to end the marriage, and has usually already decided how to equitably divide their personal and business property, and have come to agreement on custody and visitation issues. In these types of cases, the marital dissolution can usually be accomplished in an expedient, cost effective and mutually respectful manner. We can handle the paperwork and ensure that all your present and future rights are preserved. Other times, a divorce is contested — or ends on a negative note between the parties. Issues such as the best interests of the child(ren), financial support for the child(ren) or spouse, and the division of business property become contested because of emotional distress or physical abuse. When a divorce is contested, a settlement takes more time, effort and resources. Sometimes, settlement negotiations and/or meditation bring about a satisfactory outcome. Child Custody: Determining the true best interests of the child(ren) can be an emotional and difficult decision. Our understanding lawyers work with our clients to deliver an effective and compelling argument with respect to custody issues. Relocations: When one parent is planning to move out of state or perhaps even across the country, a family law court may expect to see a post-decree modification agreement that includes less frequent, but longer, visits with the non-custodial parent.
