EEOC & ACRD Complaints

What is an EEOC Complaint?

Simply put, EEOC complaints are legal complaints that are filed with the United States Equal Employment Opportunity Commission. These kinds of complaints are filed by workers who feel that they have been the victims of discriminatory treatment in the workplace. Some of the more frequently seen forms of workplace discrimination in Arizona include: age discrimination, gender discrimination, pregnancy discrimination, race discrimination, and religious discrimination. By federal law, employers are proscribed from discriminating against their employees for any of these reasons. It is illegal for Arizona employers to treat their employees in a different manner on the basis of their personal biases.

Once a person has experienced any of these or other forms of discrimination in their workplace, he or she may file an official complaint with the Equal Employment Opportunity Commission in one of three ways: by phone, by mail or in person. After a complaint has been filed with the EEOC, they will launch an investigation of the claims, and if they discover that discrimination has taken place, the employers or firms involved could find themselves facing legal action.

What is an ACRD Complaint?

Residents of the the state of Arizona who have been subjected to workplace discrimination may file a complaint with the Arizona Civil Rights Division (ACRD). Whereas complaints filed with the EEOC are on the federal level, ACRD complaints are the equivalent at the state level. The Arizona Civil Rights Division uses similar procedures to the Equal Employment Opportunity Commission: after you file a discrimination complaint with them, the ACRD will have a talk with the parties involved, notably the employee and employer in question, and thus launch an official inquiry. Before you choose to file an official complaint with either the Equal Employment Opportunity Commission or the Arizona Civil Rights Division, we strongly recommend that you review your rights and all of your legal alternatives with an expert attorney, such as the experienced Phoenix employment lawyers at Gillespie, Shields & Durrant.
