What is Employment Law?

Employment law, also known as labor law, is a field of legal practice that deals with the responsibilities of employees and the rights of employers, as well as the proper relationship between the two. Understanding this legislation is the key to outlining which employer behaviors are considered to be illegal by the state and federal governments.

What are Examples of Employment Law Violations?

Employer can violate labor laws in many different ways. For example, if an employer refuses to hire a potential employee due to bias towards that individual's age, gender, race or religion, that employer is discriminating against him or her. Another instance of a violation of employment law could be an employer who refuses to pay an employee his or her wages, overtime pay or benefits due to his or her biases. Discrimination is a direct violation of employment law and carries severe legal consequences.

What Can Employees Do?

If you believe that your employer has violated employment laws, you should understand that you have a variety of legal options. First of all, you can consult with your company's human resources department and attempt to resolve the problem internally. With human resources, you could either file a complaint or you could allow them to attempt to handle the issue themselves. If you are fortunate, the department will treat your complaints with the appropriate level of sobriety, and will conduct the necessary investigations and intervene to curtail any to illegal activities, thus rectifying your situation.

However, if this option fails and the offending individual persists in his or her unacceptable behaviors, you may wish to review your situation with an experienced attorney who specializes in dealing with employment law cases similar to yours. At Gillespie, Shields & Durrant, we will help you stand up for your rights. You do not have to tolerate discrimination in the workplace.
