What is Retaliation?
Retaliation is the legal term for when an employer chooses to demote, fire, or otherwise harass an employee who has taken any form of legal action against said employer or the company that he or she represents.
One instance of retaliation would be a situation where an employee has filed a discrimination complaint against his or her employer and is then subsequently threatened with termination by that employer.
It is illegal for employers to retaliate against their employees in the United States: employees are protected from employer retaliation by the same laws that defend against discrimination.
Proving Retaliation
There are three very important criteria that an employee must demonstrate before he or she can be considered a victim of retaliation and thus become enabled in seeking legal action. First, the employer in question must demonstrably have been involved in an adverse action. Second, the employee must prove the he or she is a legal employee of the company in question, and thus protected by anti-retaliation statutes. Lastly, it must be proven that the retaliation occurred due to the employee's participation in a protected activity, such as a sexual harassment claim against the employer. Once these three criteria have been proven, the employee can then continue to pursue legal action.
