What is Retaliation?

Retaliation is the legal term for when an employer chooses to demote, fire, or otherwise harass an employee who has taken any form of legal action against said employer or the company that he or she represents.

One instance of retaliation would be a situation where an employee has filed a discrimination complaint against his or her employer and is then subsequently threatened with termination by that employer.

Second, the employee must prove the he or she is a legal employee of the company in question, and thus protected by anti-retaliation statutes. Lastly, it must be proven that the retaliation occurred due to the employee's participation in a protected activity, such as a sexual harassment claim against the employer. Once these three criteria have been proven, the employee can then continue to pursue legal action.
