Wage/Hour/Overtime Dispute

What is a Wage/Hour/Overtime Dispute?

Wage disputes can occur when an employer refuses to pay an employee for work that he or she has completed, or when an employer neglects to pay for the total hours worked or for all the overtime hours an employee has incurred. Wage and hour disputes may also occur when an employer does not follow the state's minimum wage laws when paying employees, or when an employer neglects to pay hourly wage-earners overtime pay for any additional hours they have worked.

Both state and federal laws require employers to pay their employees at least the standard minimum wage. These regulations also require that employers compensate their hourly employees with overtime wages whenever an employer works more time than the forty hour standard week. An employee always has the legal right to file a wage dispute if an employer disregards wage and employment laws. Once an official complaint has been filed, the employee is able to sue his or her employer for the wages he or she is owed, and is also able to request extra monetary compensation for any suffering or hardships resulting from the wage dispute.

Working with a Wage Dispute Lawyer

There are several things an employee should do if he or she is facing a wage dispute. First of all, the employee should have a conversation with his or her employer and allow that individual an opportunity to make up any unpaid wages. However, if the employer refuses to pay or continues to delay the payment of wages for a lengthy amount of time, it would be wise for the employee to obtain the services of a skilled employment law attorney, such as those at the Phoenix law office of Gillespie, Shields & Durrant. We have successfully dealt with many wage dispute cases across Phoenix, Mesa, Chandler and Gilbert and we will do everything in our power to guarantee that employees are justly compensated.
