Prenuptial Agreements

Arizona Prenuptial Agreement Attorney

Premarital agreements or "prenups" are often under consideration by couples who are preparing to marry late in life, or when one of the engaged parties has children from a previous relationship, or has much greater assets than the other.

To discuss the pros and cons of preparing a prenuptial agreement with an experienced family lawyer, contact Gillespie, Shields & Durrant.

Prenuptial Agreements Need Not be a Taboo Topic Before Marriage

Our lawyers understand the delicate nature of premarital or prenuptial agreements for many people considering marriage. Legally speaking, there is no reason to view the prenup as a prediction of eventual failure of the marriage. Rather, it is rightly considered by many to be an important life planning document, similar in importance to an estate planning instrument such as a trust or a power of attorney.

It makes clear to both spouses and to any future courts what the exact intentions of parties were in the marital contract with regard to finances and legal responsibilities. Preparing a prenuptial marriage agreement together can in fact be a good opportunity for couples to discuss the legal ramifications of marriage and plan accordingly.

A postmarital agreement may be a helpful option in circumstances such as the following:

  • One spouse or the other receives an inheritance or starts a business
  • Estranged spouses wish to reconcile, but need to formalize legal and financial arrangements of the reconciliation
  • Husband and wife wish to reiterate and strengthen an existing premarital agreement

Contact Gillespie, Shields & Durrant for further information about prenuptial agreements or any question related to financial planning before a planned marriage.
